Texting Terms and Conditions

These Terms and Conditions of Use (these “Terms”) apply to the text messaging service platform utilized by The University of Kansas Health System and its affiliates (collectively referred to herein as the “health system” or “us”).
These Terms form a binding agreement with you, which you agree to when you “opt in” to receiving text messages from the health system. If you do not agree to these Terms, then you should not opt in to receiving text messages. It is important to review these Terms periodically, as we may modify them at any time.
What is the platform? How is it used?
The text messaging platform is a patient communication tool used by the health system to communicate limited information to you via standard SMS text. Receipt of text messages sent by the text messaging platform do not require you to log into a portal, such as MyChart. Related to certain types of messages sent by the text messaging platform, limited two-way communication features may be enabled (e.g., you may respond to text messages with certain indicated response prompts, such as Press “1” to confirm or “2” to cancel). At this time, the text messaging platform is not enabled to allow you to communicate freely with the health system using unstructured free text.
The health system uses the text messaging platform to provide patients, guarantors, caregivers, and authorized representatives with limited healthcare-related communications through secured, automated text messages. Messages sent using the platform may include, but are not limited to, updates related to your visits, MyChart account, one-time passcode, billing notifications, prescription reminders, and care management.
Patient activation guidelines
You may “opt in” to receiving text messages from the health system by opting in at your next appointment, logging into your MyChart account and updating your Communication Preferences, or texting START to 740684. Opt-in requests initiated by texting START to the above short code will only be recognized if the cell phone number utilized to make the request matches the cell phone number the health system has on file in your medical record. By opting in, you expressly consent to receiving text messages from the health system at the cell phone number provided to the health system.
- Consent is voluntary and is not a condition of receiving healthcare services, treatment, payment, enrollment, or eligibility for benefits.
- To opt in, you must provide a mobile phone number, email address and/or other contact information as needed. It is your responsibility to keep the contact information provided to the health system updated.
- You may adjust your communications preferences and/or update your contact information at any time. Visit the Communications Preferences tab in the MyChart main menu to choose your preferred methods of communication and to update your contact information.
Opting out
You can opt out of receiving text messages from the health system at any time by replying STOP upon receipt of a message. You may also opt out by adjusting your Communication Preferences in MyChart.
- Your opt-out request will generate one final message confirming that you have been unsubscribed from receiving text messages from the short code you opted out from.
- In the future, if you decide you would like to receive text messages again, you may opt back in using MyChart and adjusting your Communication Preferences or by texting START or HELP to 740684 for instructions.
- If you opt out of receiving text messages from the health system short code, the health system may continue to send communications to you via text in an emergency or by utilizing other methods of communication (such as email, if you have indicated email as an acceptable method of communication in your Communication Preferences).

Not for emergency care or care team communications
The text messaging platform is not monitored continuously and is not intended to be used for communication with your provider about:
- Medical emergencies
- Healthcare concerns or conditions
If you are experiencing a medical emergency, call 911 immediately or proceed to the nearest emergency department.
For general or routine healthcare needs or inquiries, call your care team’s office or message your team via MyChart. Our Health Resource Center team is always happy to help direct calls as needed and can be reached at 913-588-1227.
Patient responsibilities
If you have opted in to receive text messages, you agree that you:
- Are at least 18 years of age or have legal responsibility to act on behalf of a patient.
- Have the authority to receive communications for and/or about the patient – if you are not the patient.
- Will provide us with valid contact information.
- Will notify the health system of any changes to your contact information.
- Reasonably protect access to your mobile device.
- Review your messages promptly.
- Will not use text messaging to communicate with us regarding emergency medical concerns or to communicate clinical information.
- Will not use text messaging to transmit material to us that a reasonable person would consider abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening or malicious.
Privacy notice
Text messages you receive from us may be related to your healthcare services, appointments, providers, or billing activities.
The health system will take reasonable safeguards to protect your information, such as providing only the minimum information in a message as is necessary to accomplish the purpose of the message; however:
- Standard text messaging is inherently not secure and Messages may be viewed by any individual with access to your device or wireless account.
As such, you acknowledge that you are fully responsible for securing your personal devices, and the health system will not be held responsible for any access to your information through your personal device.
Liability disclaimers
You understand that text messages may be delayed, blocked, intercepted, or otherwise unavailable due to factors outside the health system’s control. The health system cannot guarantee, and you agree to not hold the health system liable for, any direct or indirect consequence of:
- Delayed or undelivered messages
- Telecommunications failures
- Device malfunctions
- Unauthorized access of messages by a third party
- Your failure to review or act upon communications
Message frequency may vary. Standard message and data rates may apply to any messages we send to you or you send to us according to your wireless carrier agreement. Carriers are not liable for delayed or undelivered messages.
The health system is not responsible for:
- Carrier messaging fees
- Data usage charges
- Roaming fees
- Service interruptions caused by telecommunications providers

Changes to terms and conditions
The health system reserves the right to modify these Terms at any time, and you agree that such modifications are effective and binding upon you immediately upon posting of the modified versions. Updated versions of these Terms will be posted here.
Your continued use of the text messaging platform following any changes to these Terms constitutes your acceptance of the revised Terms.
Acknowledgment
By opting in to receive text messages from the health system, you acknowledge that you have read, understand, and agree to these Terms.
